This HighPeak Online Privacy Statement (“Online Privacy Statement”) is for practices and services owned or licensed by HighPeak Innovations, LLC its parent company, Prudential, and any other affiliates ("HighPeak," “we,” “our,” or “us”). For avoidance of doubt, HighPeak Innovations, LLC is an affiliated subsidiary of Prudential Financial Inc. This Online Privacy Statement is designed to inform you of how we collect, use, safeguard, retain, and disclose your Personal Information.
This Online Privacy Statement applies to “Personal Information” we obtain from individuals (“you”) through our website(s) (collectively, our “Websites”), products, and services (collectively with the Website, the “Online Services”), and from third party and publicly available sources. Please read this Online Privacy Statement carefully before you start to use our Online Services, whether online or offline. When referenced in this Online Privacy Statement, the term “Personal Information” includes any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household, including any information that is subject to applicable data protection laws.
Our Online Services are controlled and operated by HighPeak from the United States and are intended only for use by companies based in the United States. They are not intended to subject HighPeak to the laws or jurisdictions of any state, country or territory other than those of the United States. Other Online Services of HighPeak, Prudential, and affiliates may contain different privacy statements, which supplement this Online Privacy Statement. You are advised to review the privacy statement of the applicable Prudential entity.
HighPeak is the controller (e.g., responsible party) for the Personal Information practices described in this Online Privacy Statement.
Categories of Personal Information We May Collect
The types of Personal Information we collect about you depends on how you interact with us. Depending on the Online Services you use, the following are the categories of Personal Information that we may collect or have collected.
- Business Contact Information/Identifiers, including name, email address, postal address, phone number, username, business contact information, or other similar business contact identifiers and information.
- Information Specific to the Online Services, in certain instances, such as invoices, business and commercial communications, order status and history.
- Payment Information, including credit or debit card number, or other financial information.
- Device Information and Other Unique Identifiers, device identifier, internet protocol (IP) address, or similar unique identifiers.
- Internet or Other Network Activity, including browsing or search history, and information regarding your interactions with our website, emails, advertisements, or surveys.
For avoidance of doubt, we do not collect, use, and/or process any sensitive Personal Information via our Website or Online Services.
How We Collect Your Personal Information
Depending on your relationship with us, we may ask you to provide certain Personal Information about you in order to adequately provide Online Services. For example, you may provide us with business contact information such as your name, telephone number, business mailing address, or business email address when you:
- inquire about or apply for a HighPeak product or service;
- request that a HighPeak representative contact you; and/or
- fill out an online survey;
- instruct us to perform a transaction;
- ask to receive information about our products or services;
- register for online access to access your account; and/or
- download, link to, or use our mobile apps or those maintained by a third party.
You may also provide us with your company’s financial information and goals when you use certain services, features, and tools on our Online Services. If you disclose any Personal Information relating to other people to us, or to our service providers in connection with the Online Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Online Privacy Statement.

Use and Processing of Your Personal Information
We collect and use your Personal Information for the following business purposes associated with our general business operations, to:
- Provide you with the Online Services;
- Respond to your requests and communicate with you;
- Manage your preferences;
- Perform analytics concerning your use of our Online Services, including your responses to our emails and the pages and advertisements you view;

- Manage and protect infrastructure and other business operations.
We may also use personal information for any other purposes that we may specifically disclose at the time we collect your information.
Disclosure of Your Personal Information
We respect the importance of privacy. Unless otherwise provided in this Online Privacy Statement, we do not sell your Personal Information, nor do we share it with unaffiliated third parties for their own marketing use, unless we have your consent, or we are required by law to do so. Generally, we may disclose the Personal Information we collect to facilitate our communications with users, to operate our business, to advertise for example to Financial Advisors or promote our Online Services. We may disclose the Personal Information listed above to third parties in the following ways:
- Service Providers. We may disclose Personal Information to authorized third parties who perform services for us (including cloud services, data storage, sales, human resources, and marketing). Our contracts with our service providers include commitments that they agree to limit their use of Personal Information and to comply with privacy and security standards at least as stringent as the terms of this Online Privacy Statement. Remember that if you provide Personal Information directly to a third party, such as through a link on the Site, that processing is typically based on their standards.
- Affiliated Companies. We may disclose such Personal Information with subsidiaries, affiliates or strategic partners as needed to provide our products and Online Services and generally as necessary.
- Corporate Transaction. We may disclose your Personal Information in connection with a proposed or actual corporate merger, acquisition, consolidation, sale of assets, bankruptcy, insolvency, or other corporate change. Such recipient will be bound by terms and conditions reasonably similar to those set out in this Online Privacy Statement.
- Other Parties. We may disclose your Personal Information to legal, governmental, or judicial authorities, as instructed or required by those authorities or applicable laws, or in relation to a legal activity, such as in response to a subpoena or an investigation of suspected illicit activity. - Deidentified Personal Information. We may disclose or use aggregated or de-identified data for any lawful purpose. Deidentified information is generally not considered Personal Information under applicable laws.
- Other Disclosures with Your Consent: We may ask if you would like us to disclose your Personal Information with other unaffiliated third parties who are not described elsewhere in this Notice.
We may also disclose your Personal Information as necessary in connection with business operations, limited Personal Information may be disclosed to certain business partners and their service providers in order to effectuate and manage business partnerships, as well as provide coordinated and consolidated Online Services to you. Unless you agree otherwise, we do not share your personal information with companies not affiliated with HighPeak for them to market their products or services to you. We may tell you about a product or service that other companies offer and, if you respond, that company will know that we selected you to receive the information.
Cookies and Other Tracking Technologies
Every time you come to the Website, our web server automatically collects information, including, in some instances, Personal Information, through cookies, web beacons, and other similar tracking technologies (collectively “cookies”). Cookies are small text files that are placed on your computer or mobile device when you visit a website. Children’s Privacy
Our Online Services are not directed at nor intended for children under the age of 18. We also do not knowingly collect personal information from children under the age of 18. Users under the age of 18 should not submit any Personal Information to us. If you believe we have collected Personal Information from your child in error or have questions or concerns about our practices relating to children, please notify us using the details in the “Contact Us” section below. We will take prompt steps to remove the Personal Information from our systems.
Your Choices
You may be able to make the following choices regarding your Personal Information:
- Opt-out of Marketing Communications – You may unsubscribe by clicking the unsubscribe link in the footer of the email you receive from us. Alternatively, you may tell us not to disclose your Personal Information among HighPeak companies for marketing purposes by “opting out” of such sharing. Retention Period
The time periods for which we retain your Personal Information depend on the purposes for which we use it and applicable law for the type of data and use. We will keep your Personal Information for as long as you are a registered user of our Online Services or for as long as we have a valid business purpose to do so and, thereafter, for no longer than is required or permitted by law. The Personal Information we collect is stored and processed in servers in the United States.
Security Measures
HighPeak seeks to use reasonable administrative, technical and physical safeguards and other security measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. Please note that information you send to us electronically may not be secure when it is transmitted to us. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us through the use of the Online Services. For avoidance of doubt, our Online Services are controlled and operated by HighPeak from the United States and are intended only for use by residents of the United States. They are not intended to subject HighPeak to the laws or jurisdictions of any state, country or territory other than those of the United States.

This California Resident Privacy Statement, as required by the California Consumer Privacy Act of 2018 ("CCPA"), as amended by the California Privacy Rights Act ("CPRA") applies to visitors, users, and others (e.g., employees, customers, prospects) who reside in the State of California. The information in this Privacy Statement is provided by High Peak, LLC. High Peak, LLC. providing this Privacy Statement are referred to herein as "we" or "us".

What is Personal Information?
Under the CCPA, as amended by CPRA, “Personal Information” is information that identifies, relates to, describes, references, or is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or device. The CCPA, as amended by the CPRA, however, does not apply to certain information, such as information subject to certain federal privacy laws, such as the Gramm-Leach-Bliley Act (“GLBA”) and the Health Insurance Portability and Accountability Act (“HIPAA”).
As a result, this California Resident Privacy Statement does not apply with respect to information that we collect in connection with providing financial products or services to California residents for personal, family, or household purposes or for long-term care or individual health products.
Personal Information also does not include de-identified or aggregate consumer information (such as demographic-level data or data that can no longer be tied to a single identifiable individual), or information that is publicly available (such as information from public records).
Our Collection, Use, and Disclosure of Personal Information
We collect Personal Information relating to California residents in a variety of contexts. For example, we collect Personal Information relating to individuals who request or obtain our products or services for themselves or a business, apply for employment with us, or are our employees, vendors, contractors, or similar personnel, visitors to our locations or facilities, or our shareholders. The specific Personal Information that we collect, use, and disclose relating to a California resident will depend on our relationship or interaction with that individual.
Categories of Personal Information Collected
The personal information we collect about California residents includes information within the categories below. These categories are defined by California law and represent the covered categories of personal information that we have collected about California residents, and how they have been shared, over the past 12 months. We do not necessarily collect all information listed in a particular category, nor do we collect all categories of information for all individuals.
We collect this Personal Information directly from you and from the following types of sources: publicly available databases, social media platforms, providers of demographic information, credit bureaus, advertising networks, internet service providers, data analytics providers, government entities, operating systems and platforms, educational institutions, former employers, and data brokers.
Categories of Personal Information collected include:
- identifiers including, but not limited to name, postal address, email address, and internet protocols (IP) address.
- personal Information categories listed in the California Customer Records Statute (Cal. Civ. Code § 1798.80(e)); some Personal Information included in this category may overlap with other categories.
- commercial Information including, but not limited to transaction and account information.
- internet or Other Similar Activities including, but not limited to browsing history, interactions with our websites (including keystrokes, and mouse clicks).
- geolocation Information including, but not limited to device location.
- sensory data including, but not limited to audio and electronic recording from customer service calls.
- professional or employment-related information including, but not limited to work history, prior employer, and other information necessary for verifying employment eligibility.
- Non-Public Education Information (pursuant to the Family Educational Rights and Privacy Act (20 U.S.C., Section 1232g, 34 C.F.R. Part 99)) including, but not limited to education information such as school, degrees earned, and graduation data.
- inferences drawn from other Personal Information including, but not limited to personal preferences, characteristics, and behavior.
- We do not collect Sensitive Personal Information.
- If you do not provide us with certain Personal Information, we may not be able to fulfill the requested purpose of collection, such as to respond to your queries or request for customer service or to provide the full functionality of our Services to you. However, unless otherwise specified, not providing your Personal Information will not result in legal or other consequences to you.
Purpose and Use of Personal Information Collected
The purposes for which we use the Personal Information that we collect depend on our relationship or interaction with a specific California resident. We use Personal Information:
- to operate, manage, and maintain our business.
- to provide our products and services.
- for our employment and vendor management purposes; or
- as directed by the individual the Personal Information is about or with their consent.
For example, we use Personal Information to personalize, develop, and market our products and services; conduct research and data analysis; maintain our facilities and infrastructure, protect health and safety; operate and manage IT and communications systems; facilitate communications; conduct risk and security control and monitoring; detect and prevent fraud; perform identity verification; perform accounting, audit, and other internal functions, such as internal investigations; comply with the law, legal process, and internal policies; maintain records; and exercise and defend legal claims.
Disclosure of Personal Information for Business Purposes
In the past 12 months, we have disclosed the following categories of Personal Information relating to California residents to the following categories of third parties for our business purposes.
The purposes for which we disclose Personal Information depend on our relationship or interaction with a specific California resident. We disclose for the purposes below:
- to operate, manage, and maintain our business.
- to provide our products and services.

- as directed by the individual the Personal Information is about or with their consent.
Additionally, as a financial services company, we may also receive requests for information from regulatory authorities, our auditors, and/or our legal advisors. If requested from such parties, we would share your personal information as appropriate.
Sell or Share of Personal Information

Children Under the Age of 18
Our website does not target consumers under 18 years of age. We do not knowingly collect the Personal Information of consumers under 18 years of age.
Retention of Personal Information
We retain personal information, in compliance with our records retention policies and for as long as needed based on the purpose(s) for which it was obtained and consistent with applicable law.
The criteria used to determine our retention periods include:
- the length of time we have an ongoing relationship with you and provide you with the products and services you request.
- whether there is a legal obligation we are subject to (for example, certain laws require us to keep records of certain transactions for a certain period of time before we can delete them).
- if there is a contractual obligation, we are subject to; or
- whether retention is advisable considering our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).
The same personal information about you may be used for more than one purpose, each of which may be subject to different retention periods based on the factors listed above.
Rights of California Residents
If you are a California resident, you have the following privacy rights regarding your personal information.
These rights do not apply with respect to information that we collect about you in connection with providing financial products or services for personal, family, or household purposes or for long-term care or individual health products.

Your Right to Access
You have the right to request the following information collected and disclosed by us since January 1, 2022:
- the categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information.
- the business or commercial purpose for collecting or sharing Personal Information about you.
- the categories of Personal Information about you that we disclosed to third parties for a business purpose and the categories of third parties to whom we disclosed Personal Information (if applicable).
- the specific pieces of Personal Information we have collected and retained about you.
Your Right to Delete
If you are a California resident, you may also request that we delete the Personal Information we have collected about you.
We may decline to honor your request, in full or part, for certain reasons, such as a legal exemption or where the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information by law. For example, we cannot delete information about you while continuing to provide you with financial products or services or where required to be retained for regulatory purposes.
For example, if the information you are requesting is subject to certain federal privacy laws, like the GLBA or HIPAA, that are outside the scope of the CCPA rights requests, we may decline to honor your request.
Your Right to Correct
If you are a California resident, you may also request that we correct inaccurate Personal Information that we maintain about you. We must verify your identity before honoring your request. We may also deny a request to correct if we determine that the contested Personal Information is more likely than not accurate based on the totality of the circumstances.
Your Right to Opt-Out of the Share/Sale of Your Personal Information
Right to know what Personal Information is sold or shared and to whom, and right to prohibit the sale or sharing of Personal Information: We do not and have not in the preceding 12 months, sold your Personal Information. We also do not share (in this context, share means use of your Personal Information for cross-contextual behavioral advertising) your Personal Information with third parties for marketing purposes.

Right to limit the use and disclosure of sensitive Personal Information
We will only use sensitive or special Personal Information as needed for the purposes for which it was collected or with your consent. If this changes, we will notify you, and you may have the right to restrict such additional uses.
How to Make Privacy Rights Requests
If you are a California resident, you may request to exercise your privacy rights for the Personal Information we collected about you, by contacting us at support.highpeak.ai.
For some privacy rights requests, we must verify that you are who you say you are. For example, if you have an online account with us, we may require that you log into that account as part of submitting the request.
- In some instances, you will also be asked additional questions to verify your identity. Information collected for purposes of verifying your request will only be used for verification and to respond to your Personal Information request. For deletion requests, once you submit a verifiable request for deletion you will be asked to confirm separately that you want personal information about you deleted.
Requests by Authorized Agents
A California resident may authorize an agent to make an access or deletion request on behalf of the California resident, who may do so by contacting us at support.highpeak.ai
In general, if an authorized agent makes a request on behalf of a California resident, we will:
- require that the California resident provide the authorized agent with written permission signed by the California resident authorizing the agent to make the request on the individual’s behalf (“Signed” means that the permission has either been physically signed or provided electronically in accordance with the Uniform Electronic Transactions Act, Civil Code 1633.7 et seq).
- verify the identity of the California resident as we would if the California resident were making the request directly; and
- obtain confirmation from the California resident that the individual authorized the agent to make the request.
Limiting or Declining Your Request
We may limit the response or decline to honor your request where:
- providing such information would be impossible or involve disproportionate effort (e.g., greater than 12 months prior to your request).
- we cannot verify your identity or confirm that the Personal Information that we maintain relates to you.
- we cannot verify that you have the authority to make a request on behalf of another individual.
- we may decline to honor your request where an exception applies, such as where the disclosure of Personal Information would adversely affect the rights and freedoms of another consumer; or we may also decline to honor your request where the Personal Information that we maintain about you is not subject to the CCPA’s access and/or deletion right.
Your Right to be Free from Discrimination
We are prohibited by California law from discriminating or retaliating against you (e.g., employees, applicants, independent contractors) for exercising any of these privacy rights.
Changes to this California Resident Privacy Statement
We may change or update this California Resident Privacy Statement from time to time. When we do, we will post the revised California Resident Privacy Statement on this page with a new “Last Updated” date.

HighPeak values your business and your trust. We respect the privacy of your personal information and take our responsibility to protect it seriously. We maintain physical, electronic, and procedural safeguards to protect your personal information. The people authorized to access your personal information need it to do their jobs, and we require that they keep your information secure and confidential.

We collect personal information from you, such as when you fill out surveys and other forms, when you visit or enter personal details on our websites, when you respond to our emails, and when you provide information over the telephone to your Financial Advisor. We also collect personal information about you that others give to us. Collectively, this personal information includes, for example:

- Address, email address, telephone number, and other contact information
- Employment and occupation, demographic, income, and financial information
- Certain Information related to Health
- Transaction history
- Participant information from organizations that purchase services from us for the benefit of their members or employees
- Information gathered from your internet or network activity
- Information gathered as part of internal investigations
Using Your Information
We use your personal information for various business purposes, including:
- Normal everyday business purposes, such as providing services to you on behalf of your Financial Advisor or Broker Dealer
- Strategic planning and effectuating certain business relationships and partnerships
- Business research and analysis
- Data analytics, modeling (such as predictive modeling), the deployment of automated tools, and in certain instances, artificial intelligence in accordance with applicable law or other regulatory guidance
- Business to business marketing products and services of HighPeak and other companies that may interest you
- Detecting and preventing identity theft, fraud, or misuse of your accounts
- As required by law
Disclosing Your Information
We may disclose your personal information, including information about your transactions and experiences:
- Among HighPeak and with other non-HighPeak companies that perform services for us or on our behalf for our everyday business purposes, such as providing and administering services to you, and Business-to-business marketing products and services of HighPeak and other companies that may interest you
- As necessary in connection with business operations, limited information may be disclosed to certain business partners and their service providers in order to effectuate and manage business partnerships
- With another financial institution if you agree that your personal information can be transferred to that company
- As permitted or required by law, including, for example, to law enforcement officials and regulators, in response to subpoenas, and to prevent fraud.
Unless you agree otherwise, we do not disclose your personal information with non-HighPeak companies for them to market their products or services to you. Only companies who have obtained your prior express written consent will be able to contact you.
Opt Out/Privacy Choice
We will not share your personal information for purposes other than providing services to you. Generally, we do not sell or share your personal information with non-affiliate third parties other than sharing with your Financial Advisor.
You may opt-out of consent to sharing your personal information with your Financial Advisor who requested this HighPeak service on your behalf.
